Common Consequences of Wage Garnishment

Wage garnishment occurs when a portion of your wages are withheld by an employer to satisfy a debt owed to a creditor. This legal process can be initiated by various entities, such as credit card companies, medical institutions, or government agencies.

The consequences of wage garnishment obligations can be far-reaching and include:

  • Financial strain: Wage garnishment can be financially devastating. With a portion of your income taken away, it may become increasingly challenging to cover essential expenses like rent or mortgage payments, utilities, groceries, and other bills. This can lead to a cycle of debt and stress that feels impossible to escape.
  • Emotional stress: The potential stress doesn’t stop with the serious issues noted above. Wage garnishment, by definition, involves bringing in a third party and informing them about your debts. It’s usually your employer, or it could be your bank. Either way, it’s not uncommon for people to feel shame over others having knowledge of their personal financial situation. The result can be anxiety, depression, and strained relationships.
  • Difficulty planning for the future: Wage garnishment can disrupt your long-term financial goals. Whether you're saving for retirement, planning to buy a home, or pursuing higher education, having a portion of your income taken away can hinder your ability to save and invest in your future.

One of the truly unfortunate realities of debt is that those who struggle with it are often judged unfairly by those around them. This may make them hesitant to reach out for help. We know that debt is far more pervasive than generally realized, and we know that responsible people can fall into situations through no fault of their own. Our job isn’t to judge you. Our job is to help you.

How Our Jackson Wage Garnishment Attorney Can Help

The ideal way to resolve the situation is to negotiate with your creditors and agree on a payment plan that is fair and reasonable. By bringing a lawyer into the conversation, you may incentivize your creditors to come to the bargaining table. They want their money—and we have options that can be used as leverage. Foremost among those options is filing for bankruptcy.

By filing for bankruptcy, you can put an end to wage garnishment and regain control of your financial situation. There are two ways bankruptcy can be filed: Chapter 7 and Chapter 13. Both can halt wage garnishment, providing relief from the burden of debt.

Chapter 7 Bankruptcy

When you file for Chapter 7 bankruptcy, an automatic stay is immediately put into effect. This legal protection prevents creditors from taking any collection actions against you, including wage garnishment. It provides immediate relief and gives you the opportunity to eliminate certain types of debts.

Chapter 13 Bankruptcy

With Chapter 13 bankruptcy, a repayment plan is created based on your income and expenses. This plan allows you to consolidate your debts and make affordable monthly payments over a period of three to five years. The automatic stay also applies to a Chapter 13 filing, putting a halt to wage garnishment while you work towards repaying your debts.

By filing for bankruptcy, you not only stop wage garnishment but also gain the opportunity for a fresh financial start. It allows you to discharge or restructure your debts, providing the chance to rebuild your credit and regain control over your financial future.

It's important to note that bankruptcy laws can be complex. Attorney Stover has the experience and legal knowledge to make an assessment of your financial situation. By giving you complete information, we can help you decide if you want to pursue bankruptcy and whether to choose Chapter 7 or Chapter 13.

The Limitations on Wage Garnishment in Mississippi

There are limits placed on creditors in the state of Mississippi. While there are exceptions, the standard maximum amount that can be garnished is 25% of disposable earnings. Moreover, if you have more than one creditor, the combined garnishment cannot exceed 25% of your after-tax income.

The exceptions to the 25% rule deal with child support, spousal support (alimony), and student loans. In the case of child support and alimony, the garnishment amount can rise as high as 60% of disposable income. However, in the case of student loans, garnishment is limited to 15%.

Furthermore, creditors cannot instantly garnish your wages. There is a 30-day wait required after they serve you with a formal legal order. That gives you the time to talk to our Jackson wage garnishment lawyer, let us negotiate with the creditor, and perhaps help resolve the problem before it starts.
